1. About this policy

MurkFX ("we", "us", "our") is an Australian trading education business. This policy explains how we collect, use, store and disclose your personal information when you visit murkfx.com, fill in our forms, book a call, buy our programs, or communicate with us.

We aim to handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth).

2. Who our services are for

Our services are intended for people aged 18 and over. We do not knowingly collect personal information from anyone under 18. If you believe we have, contact us and we will delete it.

3. What personal information we collect

Depending on how you interact with us, we may collect:

Contact details: name, email address, phone number, country and city.

Application and booking information: your answers to our application and onboarding forms, such as your trading experience, goals, current challenges, availability and budget.

Coaching information: information you share during mentorship, including trading journals, closed trade reviews, and information about your trading habits, behaviour and mindset. Our coaching relates to trading process and performance only. It is not medical, psychological or mental health treatment.

Call recordings and notes: audio, video and transcripts of sales and coaching calls (see section 6).

Transaction information: details of what you purchased and when. Payments are processed by Whop and PayPal. We do not receive or store your full card or bank details.

Communications: emails, SMS, direct messages on social media and other messages you send us.

Agreements: your name, signature and related details when you sign a contract electronically.

Technical information: basic data your browser sends when you visit our website, such as IP address, device and browser type, collected by our website and booking platforms.

4. How we collect it

We collect personal information directly from you when you complete a form, book a call, purchase a program, sign an agreement, join a call, message us on social media, or email or text us. Some information is collected automatically by the platforms we use to run our website and booking pages.

5. Why we collect and use it

We use your personal information to:

respond to enquiries and assess whether our programs are a good fit for you;

schedule and run sales and coaching calls;

deliver our mentorship and course, including tailoring your coaching;

process payments, issue receipts and manage contracts;

send you program updates, reminders and service messages;

send you marketing by email or SMS where you have agreed to receive it;

improve our programs and content (using de-identified information where possible);

keep records for our legal, tax and regulatory obligations, and handle complaints or disputes.

If you do not provide the information we ask for, we may not be able to book a call with you or provide our services.

6. Call recordings

We record sales and coaching calls using a note-taking tool so we can provide accurate coaching, keep records and improve our service. We will tell you at the start of each call that it is being recorded. If you do not want a call recorded, tell us before or at the start of the call.

7. Marketing and SMS

We will only send you marketing emails or SMS where you have consented or where otherwise permitted by the Spam Act 2003 (Cth). Every marketing message includes a way to opt out. You can unsubscribe by clicking the link in an email, replying STOP to an SMS, or contacting us. Opting out of marketing does not stop service messages about a program you have purchased.

8. Who we share it with

We do not sell your personal information. We share it only with service providers who help us run MurkFX, and only as needed for the purposes above. These include:

GoHighLevel (website, forms, CRM, booking, email and SMS);

Whop (course access and payments);

PayPal (payments);

DocuSign (electronic contracts);

Fathom (call recording and transcripts);

Google Workspace (email and document storage);

Zapier (automations between our tools);

Video conferencing and community platforms we use to deliver calls and sessions;

our professional advisers (such as our accountant or lawyer), where needed.

We may also disclose personal information where required or authorised by law, or to a regulator or authority.

9. Overseas disclosure

Many of our service providers store data outside Australia, mainly in the United States, and may also process it in other countries where they or their sub-processors operate. By using our services, you acknowledge your information may be stored and processed overseas. We choose reputable providers and take reasonable steps to ensure they protect your information.

10. Cookies and tracking

Our website and booking pages may use essential cookies set by our website platform so pages and forms work properly. We do not currently use advertising pixels or third-party analytics tracking. If this changes, we will update this policy.

11. How we protect and keep it

We store personal information in secure, password-protected platforms with access limited to us and anyone who assists us in running MurkFX. We keep personal information only for as long as we need it for the purposes above, or as required by law (for example, financial records are kept for at least 5 years for tax purposes). When it is no longer needed, we delete or de-identify it.

No system is completely secure. If we become aware of a data breach likely to cause you serious harm, we will notify you as soon as practicable.

12. Accessing and correcting your information

You can ask to access the personal information we hold about you, ask us to correct it, or ask us to delete it. Contact us using the details below. We will respond within 30 days. We may need to verify your identity first, and in limited cases we may be unable to delete information we must keep by law.

13. Complaints

If you have a concern about how we have handled your personal information, contact us first and we will try to resolve it within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.

14. Changes to this policy

We may update this policy from time to time. The latest version will always be available at murkfx.com/privacy-policy, with the date it was last updated.
